Trial Team Victorious Over Department of Justice
The Department of Justice brought a price-fixing charge against our client in a four-week jury trial, United States v. Gary Swanson. The BartkoZankel litigation team of John J.Bartko, Robert H. Bunzel, William Edlund, and John McLean successfully tried the case resulting in a 10:2 hung jury in favor of the defendant. The DOJ decided that it will not re-try the case. This decision was a result of the evidence and compelling trial presentation by BartkoZankel, which (i) showed through a searching analysis of a multi-million document database that inferences of criminal conduct were not supported, (ii) explained that guilty pleas by the defendant's employer and supervisors were distinguishable, and (iii) exposed the government's key witness and amnesty applicant as not credible.
